Contract
Negotiation and Preparation.
Correct
contract negotiation and preparation is key to the success of all
ICT projects. Quite often, organisations rely on lawyers to negotiate
contracts. This usually results in agreements overloaded with penalty
clauses and reasons why the project will fail.
Well
prepared contracts start with analysis of business requirements.
Understanding the client's key business
drivers allow the negotiators to create an agreement with the
suppliers that works for both parties.
Telemetrics
has skilled contracts staff that minimise the requirements for expensive
lawyers. Initial contract drafts are prepared that capture all the
key commercial terms and conditions. In most instances other facets
are also covered including intellectual property issues, copyright,
consequential loss and damages.
Contract
drafts are then passed to lawyers for preparation of executable
drafts.
